SB26 - 054 - Security Deposits & Post-Closing Occupancy Agreements

Effective Date: January 1st, 2027

Key points:

  • Security Deposit Exception:
    • Creates an exception to Colorado’s existing two-month security deposit cap for post-closing occupancy agreements which take place when a home is being sold and the seller does a short term lease to remain in the home for a short time after the sale.
  • Applicability:
    • Applies when a landlord and tenant execute a post-closing occupancy agreement after a real estate transaction.
  • Overall Impact:
    • Allows larger security deposits in limited situations involving post-closing occupancy agreements that occur after the sale of a property.
