SB23 184 - Protections For Residential Tenants

Effective Date: August 7th, 2023

Key points:

  • Limitations on Income and Credit Evaluations: Landlords are prohibited from requiring prospective tenants to have an annual income exceeding 200% of the annual rent. Additionally, landlords cannot consider or inquire about a prospective tenant's income or credit history beyond verifying that their income meets the specified threshold.

  • Security Deposit Cap: The bill restricts landlords from demanding security deposits exceeding the equivalent of two months' rent. 

  • Affirmative Defense in Eviction Proceedings: Tenants can use a landlord's violation of anti-discriminatory housing laws as an affirmative defense in eviction cases, offering them greater legal protection. 

  • These provisions aim to promote fair housing practices and provide tenants with stronger safeguards against discriminatory or excessive requirements.
