HB25 1239 - Colorado Anti-Discrimination Act

    • Affected individuals may seek court orders requiring compliance, attorney’s fees, actual monetary damages, and noneconomic damages capped at $50,000 per violation.

  • Statutory Fines:

    • Plaintiffs may recover a statutory fine of $5,000 per violation, payable directly to each individual harmed.

  • Smaller Business Exception:

    • Small businesses (≤ 25 employees and ≤ $3.5 M annual revenue) that correct violations within 30 days may have noneconomic damages reduced by 50%.

  • Unified Penalty Framework:

    • Removes duplicate or conflicting penalties across housing, public accommodations, and employment, aligning all protected classes under a streamlined enforcement structure.

  • ADA Standards Integration:

    • Courts must apply standards and defenses consistent with the federal Americans with Disabilities Act when resolving disability-based discrimination claims.
