HB20 1196 - Mobile Home Park Act Updates

Effective Date: June 30th, 2020

Key points:

  • Extended Cure and Sale Periods: Tenants now have 90 days to address certain noncompliance issues and 90 days to sell or relocate their mobile homes, increased from 30 and 60 days respectively. 

  • Termination Notice Requirements: The act specifies valid reasons for tenancy termination and mandates detailed notices, including a 12-month notice for park land-use changes leading to eviction, up from 6 months.  

  • Security Deposit Limits: Security deposits are capped at one month's rent, reduced from the previous two months' rent for multiwide units.  

  • Maintenance Obligations: Park management must maintain and repair utility service lines and provide annual water usage and billing information to homeowners.  

  • Anti-Retaliation Protections: The act prohibits management from retaliating against homeowners exercising their legal rights, with certain actions presumed retaliatory unless proven otherwise.  

  • Rule Amendments: Management can only add or amend park rules with homeowner consent or by providing a 60-day written notice.  

  • Privacy Rights: Management must respect homeowners' privacy and can only enter a mobile home lot for specific reasons, with reasonable notice, except in emergencies.  

  • This legislation aims to balance the rights and responsibilities of mobile home park residents and management, ensuring fair treatment and clear communication.
