HB25 1108 - "Letty Act" Prohibitions in Rental Agreements Due to Death

Effective Date: September 1st, 2025

Key points:

  • No Acceleration or Penalties: 

    • Rental agreements cannot demand accelerated rent beyond the month of death plus up to 10 business days, impose liquidated damages or other penalties, or require forfeiture of concessions if termination is due to the tenant’s death. 

  • Estate Handover Procedures: 

    • Landlords may retake possession without an eviction if the tenant's estate (personal representative) surrenders the unit, or, 30 days post-death, rent remains unpaid or most personal property is removed. 

  • Security Deposit Use: 

    • Landlords may withhold security or damage deposits only to cover losses directly caused by conditions related to the tenant’s death. 

  • Clear Application:

    • Applies to all rental agreements entered into on or after September 1, 2025.
