HB25 1240 - Protections for Tenants with Housing Subsidies

Effective Date: May 29th, 2025

Key points:

  • Eviction Notice Requirements:

    • Landlords must follow federal eviction notice timelines when evicting tenants who receive rental assistance. 

  • Late Fee Cap:

    • Covered tenants cannot be charged late fees exceeding $20 per late payment. 

  • Warranty of Habitability Reimbursement:

    • Landlords must reimburse tenants the difference between the rent paid and fair rental value if the unit fails to meet habitability standards—regardless of whether rent was paid via subsidy. 

  • Fair Housing Obligations Expanded:

    • Landlords must respond to requests for subsidy-related documentation, cooperate with applications, and comply regardless of their business size—small landlord exemptions are removed. 

  • Mandatory $5,000 Damages/Penalties:

    • Courts must award at least $5,000 to tenants prevailing in subsidy-related discrimination cases. The Colorado Civil Rights Commission must also impose a $5,000 fine per violation.
