SB24 134 - Operation of Home-Based Businesses

Effective Date: August 7th, 2024

Key points:

  • Prohibition of HOA Restrictions: HOAs are barred from outright banning home-based businesses operated by unit owners or residents with the owner's permission. 

  • Compliance with HOA Regulations: While HOAs cannot prohibit these businesses, they can enforce reasonable rules related to architectural control, parking, landscaping, noise, and nuisances to ensure the community's character and livability are maintained. 

  • Adherence to Local Ordinances: Home-based businesses must comply with applicable municipal and county noise and nuisance ordinances or resolutions. 

  • Definition of Home-Based Business: The act defines a home-based business as one where the main office is located at, or the business operations primarily occur at, a unit within the community. 

  • This legislation aims to balance the rights of residents to operate businesses from their homes with the interests of HOAs in maintaining community standards.
