HB25 1236 - Residential Tenant Screening

  • Exclusion of Credit Histories for Subsidized Applicants:

    • Individuals applying with housing subsidies are not required to include credit reports, scores, or evidence of adverse credit in their screening report.

  • Revised Definition of Adverse Credit Event:

    • Clarifies that late rent payments and collection accounts are considered adverse credit events. 

  • Removal of Direct Access Requirement:

    • Eliminates the provision that required tenant screening reports to be made directly available via consumer reporting agencies or third-party websites. 

  • Extended Report Validity:

    • The act allows landlords to accept a tenant-provided portable screening report that's up to 60 days old, rather than the previous 30-day limit.
