Vehicle Booting Permits:
All vehicle immobilization companies must obtain a permit from the Public Utilities Commission (PUC). The PUC may deny or revoke permits if a company fails to serve the public interest.
Pre-Boot Documentation:
Before immobilizing a vehicle, companies must document the condition of the vehicle and the justification for booting. Booting vehicles must display the company’s name, permit number, and phone number.
Restrictions on Booting Practice:
Companies cannot re-boot a vehicle already immobilized by another provider and may not charge multiple boot removal fees. Booting on private property requires written authorization or a court order. In common areas, a 24-hour notice must be posted on the vehicle before booting. Property owners must clearly post signage regarding booting enforcement. Companies are prohibited from patrolling property for enforcement purposes.
Consumer Protection Standards:
Violations are considered deceptive trade practices under the Colorado Consumer Protection Act. Offending companies may face civil penalties of up to $20,000 per violation.
