HB21 1310 - Homeowners' Association Regulation Of Flags And Signs

  • Content-Neutral Display Rights:

    • HOAs are prohibited from restricting the display of any noncommercial flags or signs based on their subject matter, message, or content.

    • This broadens previous protections that were limited to specific flags and political signs. 

  • Reasonable Regulations Permitted:

    • While content-based restrictions are disallowed, HOAs may implement reasonable, content-neutral regulations concerning the number, placement, or size of such displays.

    • For instance, an HOA can set uniform size limits for all signs or designate appropriate areas for flagpoles, provided these rules are applied equally regardless of the sign's message.

  • This legislation ensures that residents in common interest communities have the freedom to express themselves through flags and signs, while allowing HOAs to maintain aesthetic and safety standards through equitable, content-neutral rules.
